1. Acceptance and eligibility
These Terms of Service ("Terms") are an agreement between you and Minderloom, operated by Brandon Strumlauf ("Minderloom," "we," or "us"). They apply when you install or use the Minderloom Android or Wear OS application, visit minderloom.com, or participate in a Minderloom test.
By using Minderloom, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the app. Minderloom is intended for adults age 18 and older.
If you use Minderloom for work or on behalf of an organization, you confirm that you have permission to do so and that your use follows the organization's policies.
2. License, ownership, and availability
Subject to these Terms, you may install and use Minderloom on compatible personal devices for lawful personal or internal business purposes. Open-source components and source code are governed by their applicable licenses. Brand names, logos, store graphics, and other Minderloom identity assets are not granted for misleading, infringing, or impersonating use.
Minderloom is under active development. Features may be added, changed, suspended, or removed. Test builds may contain defects, lose locally stored information, use more battery than expected, or behave differently after Android, Wear OS, model, or Google service updates. Keep independent copies of information you cannot afford to lose.
Device compatibility, model availability, and Google AICore or Gemini Nano support vary. We do not promise that every feature will run on every phone, watch, account, region, or operating-system version.
3. Recording, consent, and lawful use
You are solely responsible for obtaining any notice, consent, workplace approval, or other permission required before recording or processing a conversation. Recording laws vary by location and can depend on who participates, where people are, and why the recording occurs.
You may not use Minderloom to:
- record where recording is prohibited;
- conduct covert surveillance, stalking, harassment, intimidation, or unlawful monitoring;
- violate another person's privacy, publicity, intellectual-property, employment, or contractual rights;
- collect passwords, authentication codes, financial credentials, protected health records, privileged communications, or regulated information without proper authorization;
- evade device privacy indicators or security controls; or
- use generated summaries or observations to defame, threaten, discriminate against, or make unlawful decisions about another person.
You are responsible for the content you capture, store, label, export, or send to another service.
4. AI, transcription, speaker labels, and reminders
Transcripts, speaker labels, summaries, suggested tasks, timing classifications, semantic search results, tone cues, and Conversation Lens observations can be wrong or incomplete. Noise, accents, overlapping speech, missing context, model limitations, and transcript corrections can change the result.
You must review important output before acting on it. Do not rely on Minderloom as the only record of a commitment, deadline, emergency, legal obligation, safety issue, financial instruction, medical direction, or workplace requirement.
Anonymous speaker separation does not identify a person. Optional speaker enrollment may produce false matches. Enroll a speaker only with that person's permission, and verify labels before using them.
Conversation Lens highlights wording for reflection. It does not determine whether someone is truthful, manipulative, abusive, dangerous, or mentally unwell. It cannot replace your judgment or qualified professional support.
Minderloom is a productivity and reflection tool. It is not a medical device, mental-health service, emergency service, legal service, lie detector, or substitute for professional advice. If you or someone else may be in immediate danger, contact local emergency services or a qualified local resource.
5. Optional third-party services
Minderloom may connect to services you choose, including Google Tasks, Google Drive, Android calendars, document providers, Android AICore, model hosts, a local-network AI endpoint, or a private HTTPS gateway.
Your use of those services is also governed by their terms and privacy practices. We do not control their availability, pricing, quotas, content, retention, model behavior, or account decisions. A consumer or workplace chat subscription does not necessarily include API access.
Google access is optional. You may revoke it in Minderloom or through your Google Account. Revocation stops future authorized operations but does not automatically delete Google Tasks or encrypted Drive files already created.
6. Your data, deletion, and backups
Minderloom stores most information locally. You are responsible for securing your devices, selecting appropriate retention settings, keeping enough free storage, and maintaining any backup you need.
Encrypted backups depend on a key held in Android Keystore. Clearing app data, losing the device, or uninstalling may make an encrypted backup unrecoverable in this release. We cannot recover that key for you.
Delete local data before transferring or disposing of a device. Manage external copies separately, including calendar events, Google Tasks, Drive app data, files in a selected document-provider folder, and content sent to an endpoint you configured.
See the data deletion instructions for the current controls.
7. Disclaimers and limits
To the maximum extent permitted by applicable law, Minderloom is provided "as is" and "as available" without warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, data preservation, or error-free operation.
To the maximum extent permitted by applicable law, Minderloom and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, missed reminders, lost profits, relationship decisions, device costs, or claims arising from unlawful or inappropriate recording. Some jurisdictions do not allow particular exclusions, so these limits may not apply to you.
Nothing in these Terms excludes rights or responsibilities that cannot legally be excluded. Mandatory consumer protections in your location remain in effect.
You agree to take reasonable responsibility for claims caused by your unlawful recording, misuse of another person's information, violation of these Terms, or infringement of another person's rights, to the extent permitted by law.
8. Suspension, changes, and contact
You may stop using Minderloom at any time and remove it from your devices. We may suspend access to a distributed test or discontinue a feature when reasonably needed for security, legal compliance, maintenance, or product changes.
We may update these Terms. Material changes will receive a new effective date and, where appropriate, an in-app notice. Continued use after the revised Terms take effect means you accept them.
These Terms are governed by applicable law, without limiting mandatory protections available to you. If a provision cannot be enforced, the remaining provisions continue in effect. These Terms and the Privacy Policy are the agreement concerning the covered services unless another written agreement applies.
